Ekminuteweb.com (owned by Bizsomia Technology Private Limited) is an online platform that helps business owners/freelancers to create instant website and attract new business opportunities.

As used in these Terms of Service, “we”, “us”, ”company” and “Bizsomia” means Bizsomia Technology Private Limited

These ‘Terms of Use’ govern when you use our services through our website or mobile application. It also applies to any firm/legal entity which may be represented by any person who accesses or uses this platform. These ‘Terms of Use’ are published in accordance with the provisions of Rule 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011 that require publishing of the rules and regulations, Privacy Policy, and Terms of Use for accessing and using our Platform.

User(s) Commitment

You would complete the registration process and create the profile with fairness and honesty by furnishing true, accurate and complete information about self and firm.
You own the content and information that you submit or post to the Platform. You will be responsible for all content posted by account linked to your phone number.
You agree to only provide content or information that does not violate the law nor anyone’s rights (including intellectual property rights).
You agree that you will comply with all applicable laws, including, without limitation, privacy laws, intellectual property laws, anti-spam laws and regulatory requirements.
You agree that you will not:

create a false profile or misrepresent your identity or use or attempt to use another’s account
develop, support or use software, scripts, or any other means or processes to harm the platform or otherwise copy profiles and other data from the platform
override or circumvent any security feature or any access controls
disclose information that you do not have the consent to disclose (such as confidential information of others)
violate the intellectual property rights of others, including copyrights, patents, trademarks, trade secrets, or other proprietary rights
post anything that contains software viruses, or any other harmful code

Company reserves the right to remove certain information/content if it is against our Terms of Use.
Company reserves the right to terminate your registration and/or refuse you access to the Platform at any point of time.

Account Security

You are responsible for safeguarding the confidentiality of your login credentials such as your User ID, Password, OTP, etc., and for restricting access to your computer/mobile to prevent unauthorized access to your account. You shall be solely liable and responsible for all the activities undertaken under Your Account, and any consequences thereafter.

If you share or allow others to have access to your account, you shall be solely liable and responsible for all the activities undertaken under your Account, and any consequences there from.

Intellectual Property and Customer Content

We do not claim any intellectual property rights over the Materials you provide to the Ekminuteweb.com. All material/data you upload to your website remains yours. You can remove your material/data at any time by deleting your Account.
You retain ownership over all material/data that you upload to the Website; however, you agree to allow others to view material/data that you post publicly to your Website. You are responsible for compliance of the material/data with any applicable laws or regulations.
Bizsomia shall have the non-exclusive right and license to use the names, trademarks, service marks and logos associated with your website to promote the Service.

Paid Services

Billing Policies:

Certain premium features/services are provided for a fee or other charge. If you choose to use such paid features, you agree to the pricing and payment listed on the Service which we may update from time to time.
We may add new features/services for additional fees and charges, or amend fees and charges for existing features/services, at any time in its sole discretion; however, any price changes or changes to your subscription plans will apply no earlier than 30 days following notice to you.

No Refunds:

There is no refund allowed for any subscription fees or for any unused portion of the Service.
In the event that company suspends or terminates your account or this Agreement, you understand and agree that you shall receive no refund or exchange for any unused time on a subscription, any subscription fees for any portion of the Service, any content or data associated with your account, or for anything else.

Payment and Taxes:

All information that you provide in connection with a purchase or transaction or other monetary transaction interaction with the Service must be accurate, complete, and current
You agree to pay all charges incurred on your credit card, debit card, or other payment method used in connection with a purchase or transaction or other monetary transaction interaction with the Service at the prices in effect when such charges are incurred.
You will pay any applicable taxes, if any, relating to any such purchases, licenses, royalties, transactions, or other monetary transaction interactions.

Applicable Law

‘Terms of Use’ shall be governed, interpreted, and construed in accordance with the laws of India. The place of jurisdiction shall exclusively be Surat, Gujarat.

Jurisdictional Issues/Sale in India Only

Company makes no representation that the material on the Website is appropriate or available for use in other locations/countries other than India. Those who choose to access the Website from other locations/countries other than India do so on their own initiative and Company is not responsible for supply of products/refund for the products ordered from other locations/countries other than India and compliance with local laws, if and to the extent local laws are applicable.

Limitation of Liability

You expressly understand and agree that, to the extent permitted by applicable laws, Bizsomia shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses resulting from the use of or inability to use the Service.
User(s) hereby further agree to indemnify and save Bizsomia, its affiliates, directors, officers and employees harmless, from any and all losses, claims, liabilities (including legal costs on a full indemnity basis) which may arise, directly or indirectly, as a result of any claims asserted by Third Party Rights claimants or other third parties relating to products offered or displayed on the platform.
User(s) hereby further agree that Bizsomia is not responsible and shall have no liability for any material posted by other User(s) or any other person, including defamatory, offensive or illicit material and that the risk of damage from such material rests entirely with the User(s).
Your use of the Services is at your sole risk. The Services are provided on an “as is” and “as available” basis without any warranty or condition, express, implied or statutory.
